Terms of Service

1. General Provisions

  1. These Terms of Service (hereinafter: "Terms") govern the use of the DataClip website (hereinafter: "Website").
  2. The owner and operator of the Website is DataClip Kinetic Systems (hereinafter: "Service Provider").

  4. These Terms constitute terms and conditions for providing electronic services within the meaning of applicable Polish and EU legislation on electronic services.
  5. By using the Website, you agree to these Terms.

2. Definitions

  • Website — the DataClip website together with all its subpages.
  • User — any natural person using the Website.
  • Service — a service provided electronically by the Service Provider to the User through the Website.
  • Waiting List (Waitlist) — a service consisting of registering the User's email address in order to receive information about the launch of the DataClip platform.
  • DataClip Platform — a planned tool for creating animated data visualizations in video format, which is the subject of announcements on the Website. As of the date of publication of these Terms, the platform is not yet publicly available.

3. Types and Scope of Services

The Website provides the following electronic services:

  1. Informational content — presenting information about the planned DataClip platform, its features, and templates.
  2. Waiting list — enabling Users to sign up for a mailing list to receive notification when the platform launches.
  3. Contact form / email — enabling communication with the Service Provider.

All listed services are provided free of charge.

4. Technical Requirements

To use the Website, you need:

  • a device with internet access,
  • a web browser supporting HTML5, CSS3, and JavaScript (e.g., Chrome 90+, Firefox 90+, Safari 15+, Edge 90+),
  • an active internet connection.

An active email address is required to sign up for the waiting list.

5. Rules of Use

  1. The User agrees to use the Website in accordance with applicable law, these Terms, and good practices.
  2. The following is prohibited:
    • taking actions that may disrupt the functioning of the Website,
    • providing false or another person's personal data,
    • using the Website to distribute unsolicited commercial communications (spam),
    • attempting to gain unauthorized access to the Service Provider's IT systems.

6. Waiting List

  1. Registration for the waiting list is done by providing an email address in the form on the Website and clicking the signup button.
  2. Registration is voluntary and constitutes consent to receive information about the launch of the DataClip platform at the provided email address.
  3. The User may unsubscribe from the waiting list at any time by clicking the "Unsubscribe" link in any received email or by contacting the Service Provider at dataclipapp@gmail.com.
  4. The Service Provider does not guarantee a specific launch date for the DataClip platform.
  5. The mailing list is managed through MailerLite. Details about data processing can be found in the Privacy Policy.

7. Intellectual Property

  1. All content published on the Website — including texts, graphics, logos, icons, photographs, video materials, and page layout — is the property of the Service Provider or is used under appropriate licenses and is protected under applicable copyright law and EU regulations.
  2. Copying, distributing, modifying, or using the Website's content for commercial purposes without the prior written consent of the Service Provider is prohibited.
  3. The name "DataClip" and related graphic marks are designations of the Service Provider.

8. Liability

  1. The Service Provider makes every effort to ensure the Website operates continuously and without interruption, but does not guarantee uninterrupted availability.
  2. The Service Provider shall not be liable for:
    • interruptions in the Website's operation due to technical reasons (maintenance, updates, outages),
    • damages resulting from the use of the Website in a manner inconsistent with the Terms,
    • content posted on external websites linked from the Website.
  3. Information presented on the Website regarding the planned DataClip platform is for informational purposes only and does not constitute a binding offer.

9. Personal Data Protection

The rules for processing Users' personal data are set out in the Privacy Policy, which forms an integral part of these Terms.

10. Complaints

  1. The User has the right to file complaints regarding the functioning of the Website.
  2. Complaints should be sent by email to: dataclipapp@gmail.com.
  3. A complaint should include:
    • the User's contact details (email address),
    • a description of the issue,
    • the expected resolution.
  4. The Service Provider will process the complaint within 14 days of receipt and inform the User of the outcome by email.

11. Out-of-Court Dispute Resolution

In accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council, consumers may use the ODR (Online Dispute Resolution) platform available at: https://ec.europa.eu/consumers/odr.

Users may also seek assistance from local consumer protection bodies or organizations whose statutory purpose includes consumer protection.

12. Amendments to the Terms

  1. The Service Provider reserves the right to amend these Terms for important reasons, in particular:
    • changes in legislation affecting the services provided,
    • changes in the scope or manner of service provision,
    • the need to adapt the Terms to recommendations, decisions, or rulings of public authorities.
  2. Amended Terms take effect on the date of publication on the Website. Continued use of the Website after changes take effect constitutes acceptance of the new Terms.
  3. Users registered on the waiting list will be notified of material changes to the Terms by email.

13. Governing Law and Jurisdiction

  1. These Terms are governed by Polish law.
  2. Matters not regulated by these Terms are governed by applicable Polish law, including:
    • the Polish Civil Code,
    • the Act on Providing Electronic Services,
    • the Consumer Rights Act,
    • Regulation (EU) 2016/679 (GDPR).
  3. The choice of Polish law does not deprive consumers from other EU Member States of the protection granted by mandatory provisions of the law of their country of residence (Art. 6(2) of the Rome I Regulation).
  4. Disputes arising from the use of the Website shall be resolved by competent courts in accordance with Polish law, subject to different provisions applicable to consumers.
